LEGAL NOTICE

PUBLIC MEETINGS OF THE PALM BEACH COUNTY CANVASSING BOARD FOR THE JANUARY 29, 2008, PRESIDENTIAL PREFERENCE PRIMARY ELECTION

In accordance with the Sunshine Law of Florida, all Canvassing Board meetings are open to the public.

The sealed absentee ballots received prior to 9:00 a.m. Wednesday, January 23rd, 2008, for the Presidential Preference Primary Election will be available for public inspection from 9:00 a.m. until 10:00 a.m. on Wednesday, January 23rd, at the Supervisor of Elections Absentee Ballot Facility, 4215 Cherry Road, West Palm Beach, FL. Immediately afterwards, the Supervisor of Elections Staff will commence the opening and processing, but not the tabulation, of those absentee ballots and any absentee ballots subsequently received, until 6:00 p.m. or thereafter as needed, and resuming on Thursday, January 24th, 9:00 a.m., and continuing from day to day as needed until completed. Unless otherwise posted, the opening and processing of the absentee ballots received by January 29, 2008 will take place at 4215 Cherry Road, West Palm Beach, FL. Tabulation of the results from all processed absentee ballot will not begin until after 7:00 p.m. on Tuesday, January 29th, 2008. Any absentee ballots received after 9:00 a.m. Wednesday, January 23rd will be available for public inspection until opened. Those wishing to inspect any remaining unopened absentee ballots must make a timely request to do so, and be readily available to promptly make such an inspection upon the Supervisor of Elections’ daily receipt of such absentee ballots prior to their opening. 

At 10:00 a.m. on Wednesday, January 23th, 2008, the Canvassing Board will convene and remain in session from day to day as needed for canvassing of the absentee ballots and other Board business at the Supervisor of Elections Absentee Ballot Facility, 4215 Cherry Road, West Palm Beach, FL., or such other location as may be posted, and will continue to meet at that facility from day to day until the Canvassing of the Absentee Ballots is no longer needed at that location. By 5:00 p.m. on January 29, 2008, or upon the completion of the need to canvass absentee ballots at the 4215 Cherry Road Facility, whichever may occur sooner, the Canvassing Board will commence meeting at 240 South Military Trail, West Palm Beach, FL, unless otherwise posted, for canvassing of any additional absentee ballots, and other Board business, and will take up and oversee the testing of the tabulating equipment pursuant to Florida Statute Section 101.5612 at 5:00 p.m. on January 29th, 2008, before the start of the official count of the ballots, and thereafter the Canvassing Board will remain in session on the evening of January 29th, 2008, to further canvass absentee ballots, provisional ballots, precinct returns, and take up other Board business. Thereafter the Palm Beach County Canvassing Board will remain in session from day to day to complete canvassing duties and other Board business until the results of the Election are obtained and finalized. 

It may become necessary for the Canvassing Board to reconvene at times, dates, or places other than those specified above. If so, the location, date and time will be announced at the conclusion of the preceding or pertinent meeting and posted at the Supervisor of Elections Office. 

NOTE: Section 101.68(2)(c)2, Florida Statutes, states that if any elector or candidate present believes that an absentee ballot is illegal due to a defect apparent on the voter’s certificate, he or she may, at any time before the ballot is removed from the envelope, file with the canvassing board a protest against the canvass of that ballot, specifying the precinct, the ballot, and the reason he or she believes the ballot to be illegal. A challenge based upon a defect in the voter’s certificate may not be accepted after the ballot has been removed from the mailing envelope.

NOTE: Section 286.0105, Florida Statues, states that if a person decides to appeal any decision by a board, agency, or commission with respect to any matter considered at a meeting, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. It shall be the responsibility of any person needing such a record to arrange for and obtain such a verbatim record at his/her own cost and expense.

In accordance with the Americans with Disabilities Act (ADA), if any person with a disability, as defined by the ADA, needs special accommodation to participate in these meetings, then not later than two business days prior to the pertinent meeting or meetings, he or she should contact the Supervisor of Elections at (561) 656-6200.
